引言 / Introduction

中文： 欢迎使用 5itui（以下简称“本平台”或“我们”）提供的VR全景在线制作及相关服务。本平台是一款在线VR全景内容创作与管理工具，为用户提供全景图片上传、全景场景编辑、热点交互设置、VR作品发布与展示等功能。

English: Welcome to the VR panoramic online production and related services provided by 5itui (hereinafter referred to as the "Platform" or "we"). The Platform is an online VR panoramic content creation and management tool that provides users with functions such as panoramic image upload, panoramic scene editing, hotspot interaction settings, and VR work publishing and display.

English: Before using the Platform's services, you must carefully read and fully understand all terms of this Agreement, especially those important terms marked in bold, underlined, or otherwise highlighted. By registering, logging in, or using the Platform's services in any way, you are deemed to have fully understood and completely accepted all contents of this Agreement.

一、服务内容与说明 / I. Service Content and Description

1.1 中文： 本平台向用户提供VR全景在线制作服务，包括但不限于：全景图片与视频的上传与处理、全景场景的创建与编辑、热点与交互功能设置、VR作品的在线预览与发布、作品链接的分享与嵌入等功能。具体服务内容以平台实际提供为准。

1.1 English: The Platform provides users with online VR panoramic production services, including but not limited to: upload and processing of panoramic images and videos, creation and editing of panoramic scenes, setting of hotspot and interaction functions, online preview and publishing of VR works, and sharing and embedding of work links. Specific service contents shall be subject to those actually provided by the Platform.

1.2 中文： 您理解并同意，本平台部分功能可能依赖于第三方服务（如云存储、内容分发网络、AI智能生成等），我们不对第三方服务的可用性、稳定性和准确性做出任何保证。

1.2 English: You understand and agree that some functions of the Platform may rely on third-party services (such as cloud storage, content delivery networks, AI-powered generation, etc.), and we make no guarantees regarding the availability, stability, or accuracy of such third-party services.

1.3 中文： 本平台有权根据自身运营策略或法律法规要求，对服务内容进行调整、升级、暂停或终止，并尽可能提前通过平台公告等方式通知您。

1.3 English: The Platform has the right to adjust, upgrade, suspend, or terminate the service contents based on its own operational strategies or legal and regulatory requirements, and shall, to the extent possible, notify you in advance through platform announcements or other means.

二、用户注册与账户安全 / II. User Registration and Account Security

2.1 中文： 您在注册时应提供真实、准确、完整的个人信息，并在信息变更时及时更新。因信息不实或不完整引发的任何后果，由您自行承担。

2.1 English: When registering, you shall provide true, accurate, and complete personal information and promptly update it when changes occur. You shall bear any consequences arising from false or incomplete information.

2.2 中文： 您的账户（包括用户名、密码、绑定的手机号码及邮箱等）是您在本平台的唯一身份标识，您应妥善保管账户信息和密码。任何通过您的账户进行的操作均视为您本人的行为，由您自行承担相应的法律责任。

2.2 English: Your account (including username, password, bound mobile phone number, email address, etc.) is your unique identity credential on the Platform. You shall properly safeguard your account information and password. Any operation conducted through your account shall be deemed your own act, and you shall bear the corresponding legal liability.

2.3 中文： 如您发现账户被盗用或存在安全漏洞，请立即通知我们。因您自身原因导致账户、密码泄露而产生的损失，本平台不承担责任。

2.3 English: If you discover that your account has been misappropriated or that a security vulnerability exists, please notify us immediately. The Platform shall not be liable for losses arising from the leakage of your account or password due to your own reasons.

三、用户内容与知识产权 / III. User Content and Intellectual Property

3.1 中文： 您通过本平台上传、创作、发布的VR全景作品（包括但不限于全景图片、视频、音频、文字描述、交互设置等，以下统称“用户内容”），其知识产权仍归您或您的合法授权方所有。

3.1 English: The intellectual property rights of VR panoramic works you upload, create, or publish through the Platform (including but not limited to panoramic images, videos, audio, text descriptions, interactive settings, etc., collectively referred to as "User Content") shall remain owned by you or your lawful licensor.

3.2 中文： 您授予本平台在提供服务所必需的范围内，对您的用户内容进行存储、处理、展示和传输的权利。此授权仅限于为您提供平台服务之目的，我们不会将您的用户内容用于其他商业用途。

3.2 English: You grant the Platform the right to store, process, display, and transmit your User Content to the extent necessary to provide services. This authorization is limited to the purpose of providing Platform services to you, and we will not use your User Content for other commercial purposes.

3.3 中文： 您保证对上传至本平台的所有内容拥有合法权利或已获得必要授权，不侵犯任何第三方的知识产权、肖像权、隐私权、名誉权等合法权益。

3.3 English: You warrant that you have lawful rights to all content uploaded to the Platform or have obtained necessary authorization, and that such content does not infringe upon any third party's intellectual property rights, portrait rights, privacy rights, reputation rights, or other lawful rights and interests.

3.4 中文： 您理解并同意，您在平台发布的公开作品可能会被其他用户浏览、分享。对于您选择公开发布的内容，您应自行评估由此可能产生的风险。

3.4 English: You understand and agree that publicly published works on the Platform may be browsed and shared by other users. You shall assess the risks that may arise from content you choose to publish publicly.

3.5 中文： 本平台（包括但不限于平台名称、Logo、界面设计、技术架构、软件代码等）的知识产权归本平台运营者所有。未经明确书面许可，您不得对上述内容进行复制、修改、反向工程或以其他方式使用。

3.5 English: The intellectual property rights of the Platform (including but not limited to the platform name, logo, interface design, technical architecture, software code, etc.) belong to the Platform operator. Without express written permission, you may not copy, modify, reverse engineer, or otherwise use the foregoing content.

四、用户行为规范 / IV. User Conduct Rules

4.1 中文： 您在使用本平台服务时，应严格遵守中华人民共和国法律法规，不得利用本平台从事任何违法违规活动。

4.1 English: When using the Platform's services, you shall strictly comply with the laws and regulations of the People's Republic of China and shall not use the Platform to engage in any illegal or non-compliant activities.

4.2 中文： 您不得利用本平台制作、上传、发布、传播以下内容：

4.2 English: You shall not use the Platform to create, upload, publish, or disseminate any of the following content:

（1）中文： 反对宪法所确定的基本原则，危害国家安全，泄露国家秘密，颠覆国家政权，破坏国家统一的；

（1）English: Opposing the basic principles established by the Constitution, endangering national security, divulging state secrets, subverting state power, or undermining national unity;

（2）中文： 损害国家荣誉和利益，损害公共利益的；

（2）English: Harming national honor and interests, or harming public interests;

（3）中文： 煽动民族仇恨、民族歧视，破坏民族团结的；

（3）English: Inciting ethnic hatred or ethnic discrimination, or undermining ethnic unity;

（4）中文： 破坏国家宗教政策，宣扬邪教和封建迷信的；

（4）English: Undermining national religious policies, or promoting cults and feudal superstitions;

（5）中文： 散布谣言，扰乱社会秩序，破坏社会稳定的；

（5）English: Spreading rumors, disrupting social order, or undermining social stability;

（6）中文： 含有淫秽、色情、赌博、暴力、凶杀、恐怖或教唆犯罪内容的；

（6）English: Containing obscene, pornographic, gambling, violent, homicide, terrorist, or crime-inciting content;

（7）中文： 侮辱、诽谤他人，侵害他人名誉权、隐私权、肖像权、知识产权等合法权益的；

（7）English: Insulting or defaming others, or infringing upon others' reputation rights, privacy rights, portrait rights, intellectual property rights, or other lawful rights and interests;

（8）中文： 含有虚假、欺诈、误导性信息的；

（8）English: Containing false, fraudulent, or misleading information;

（9）中文： 含有法律法规禁止的其他内容的。

（9）English: Containing other content prohibited by laws and regulations.

4.3 中文： 您不得利用本平台从事以下行为：

4.3 English: You shall not use the Platform to engage in any of the following acts:

（1）中文： 对平台进行反向工程、反向汇编、反向编译，或以其他方式试图获取平台源代码；

（1）English: Reverse engineering, reverse assembling, reverse compiling the Platform, or otherwise attempting to obtain the Platform's source code;

（2）中文： 使用任何自动化工具（如爬虫、脚本）批量采集平台数据或其他用户内容；

（2）English: Using any automated tools (such as crawlers or scripts) to mass collect Platform data or other users' content;

（3）中文： 干扰、破坏或限制平台的正常运作，包括但不限于传播病毒、木马、恶意代码等；

（3）English: Interfering with, damaging, or restricting the normal operation of the Platform, including but not limited to spreading viruses, Trojans, malicious code, etc.;

（4）中文： 利用平台漏洞进行非法活动或牟取不正当利益；

（4）English: Exploiting Platform vulnerabilities for illegal activities or improper benefits;

（5）中文： 未经许可，将本平台服务转售、出租或提供给第三方使用。

（5）English: Reselling, renting, or providing the Platform's services to third parties for use without permission.

4.4 中文： 如您违反上述规定，本平台有权采取警告、限制功能、暂停服务、删除内容、永久封禁账户等措施，并保留追究法律责任的权利。

4.4 English: If you violate the above provisions, the Platform has the right to take measures including warnings, restricting functions, suspending services, deleting content, and permanently banning accounts, and reserves the right to pursue legal liability.

五、费用与支付 / V. Fees and Payment

5.1 中文： 本平台部分功能为短期免试用方式提供，后续功能或增值服务可能需要付费使用。具体收费标准、计费方式以平台页面公示为准。

5.1 English: Some functions of the Platform are provided on a short-term free trial basis, and subsequent functions or value-added services may require payment. Specific charging standards and billing methods shall be subject to those published on the Platform pages.

5.2 中文： 您通过本平台支持的支付方式进行充值或购买服务时，即视为同意按照公示的收费标准支付相应费用。

5.2 English: When you recharge or purchase services through payment methods supported by the Platform, you are deemed to agree to pay the corresponding fees in accordance with the published charging standards.

5.3 中文： 除法律法规另有规定或平台特别说明外，已消费的充值金额及购买的套餐服务不予退款。

5.3 English: Except as otherwise provided by laws and regulations or specifically stated by the Platform, consumed recharge amounts and purchased package services are non-refundable.

六、免责声明与责任限制 / VI. Disclaimer and Limitation of Liability

6.1 中文： 您理解并同意，本平台服务按“现状”和“可得到”的基础提供，我们不对服务的及时性、准确性、可靠性、完整性做任何明示或默示的保证。

6.1 English: You understand and agree that the Platform's services are provided on an "as is" and "as available" basis, and we make no express or implied warranties regarding the timeliness, accuracy, reliability, or completeness of the services.

6.2 中文： 因不可抗力（包括但不限于自然灾害、战争、政策变化、网络攻击、电力中断、第三方服务故障等）导致服务中断或数据丢失的，本平台不承担责任，但我们将尽合理努力减少对您的影响。

6.2 English: The Platform shall not be liable for service interruptions or data loss caused by force majeure (including but not limited to natural disasters, war, policy changes, cyberattacks, power outages, third-party service failures, etc.), but we will make reasonable efforts to reduce the impact on you.

6.3 中文： 您在使用本平台服务过程中，应自行备份重要数据。本平台不对因您的操作失误、账户丢失、密码泄露等原因导致的数据丢失承担责任。

6.3 English: During your use of the Platform's services, you should back up important data yourself. The Platform shall not be liable for data loss caused by your operational errors, account loss, password leakage, or other reasons attributable to you.

6.4 中文： 在适用法律允许的最大范围内，本平台对您的全部责任，以您在本平台遭受损失前十二个月内实际支付的费用总额为限。

6.4 English: To the maximum extent permitted by applicable law, the Platform's total liability to you shall be limited to the total amount of fees you actually paid to the Platform in the twelve months before the loss occurred.

七、协议的变更与终止 / VII. Amendment and Termination

7.1 中文： 本平台有权根据需要修订本协议，修订后的协议一经公布即生效。如您不同意修订后的协议，应立即停止使用本平台服务。

7.1 English: The Platform has the right to revise this Agreement as needed, and the revised Agreement shall take effect upon publication. If you do not agree to the revised Agreement, you should immediately stop using the Platform's services.

7.2 中文： 您可以在账户设置中自行注销账户。注销后，我们将依法处理您的个人信息和用户内容。

7.2 English: You may cancel your account in the account settings. After cancellation, we will handle your personal information and User Content in accordance with law.

八、法律适用与争议解决 / VIII. Governing Law and Dispute Resolution

8.1 中文： 本协议的订立、履行、解释及争议解决均适用中华人民共和国大陆地区法律。

8.1 English: The conclusion, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the mainland region of the People's Republic of China.

8.2 中文： 因本协议引起的任何争议，双方应首先友好协商解决。协商不成的，任何一方均有权向本平台运营者住所地有管辖权的人民法院提起诉讼。

8.2 English: Any dispute arising from this Agreement shall first be resolved through friendly negotiation between the parties. If negotiation fails, either party has the right to file a lawsuit with the people's court having jurisdiction at the domicile of the Platform operator.

3.1 English: The intellectual property rights of VR panoramic works you upload, create, or publish through the Platform (including but not limited to panoramic images, videos, audio, text descriptions, interactive settings, etc., collectively referred to as "User Content") shall remain owned by you or your lawful licensor.

3.2 中文： 您授予本平台在提供服务所必需的范围内，对您的用户内容进行存储、处理、展示和传输的权利。此授权仅限于为您提供平台服务之目的，我们不会将您的用户内容用于其他商业用途。

3.2 English: You grant the Platform the right to store, process, display, and transmit your User Content to the extent necessary to provide services. This authorization is limited to the purpose of providing Platform services to you, and we will not use your User Content for other commercial purposes.

3.3 中文： 您保证对上传至本平台的所有内容拥有合法权利或已获得必要授权，不侵犯任何第三方的知识产权、肖像权、隐私权、名誉权等合法权益。

3.3 English: You warrant that you have lawful rights to all content uploaded to the Platform or have obtained necessary authorization, and that such content does not infringe upon any third party's intellectual property rights, portrait rights, privacy rights, reputation rights, or other lawful rights and interests.

3.4 中文： 您理解并同意，您在平台发布的公开作品可能会被其他用户浏览、分享。对于您选择公开发布的内容，您应自行评估由此可能产生的风险。

3.4 English: You understand and agree that publicly published works on the Platform may be browsed and shared by other users. You shall assess the risks that may arise from content you choose to publish publicly.

3.5 中文： 本平台（包括但不限于平台名称、Logo、界面设计、技术架构、软件代码等）的知识产权归本平台运营者所有。未经明确书面许可，您不得对上述内容进行复制、修改、反向工程或以其他方式使用。

3.5 English: The intellectual property rights of the Platform (including but not limited to the platform name, logo, interface design, technical architecture, software code, etc.) belong to the Platform operator. Without express written permission, you may not copy, modify, reverse engineer, or otherwise use the foregoing content.

四、用户行为规范 / IV. User Conduct Rules

4.1 中文： 您在使用本平台服务时，应严格遵守中华人民共和国法律法规，不得利用本平台从事任何违法违规活动。

（8）中文： 含有虚假、欺诈、误导性信息的；

（9）中文： 含有法律法规禁止的其他内容的。

4.3 中文： 您不得利用本平台从事以下行为：

（4）中文： 利用平台漏洞进行非法活动或牟取不正当利益；

（4）English: Exploiting Platform vulnerabilities for illegal activities or improper benefits;

（5）中文： 未经许可，将本平台服务转售、出租或提供给第三方使用。

（5）English: Reselling, renting, or providing the Platform's services to third parties for use without permission.

4.4 中文： 如您违反上述规定，本平台有权采取警告、限制功能、暂停服务、删除内容、永久封禁账户等措施，并保留追究法律责任的权利。

4.4 English: If you violate the above provisions, the Platform has the right to take measures including warnings, restricting functions, suspending services, deleting content, and permanently banning accounts, and reserves the right to pursue legal liability.

五、费用与支付 / V. Fees and Payment

5.1 中文： 本平台部分功能为短期免试用方式提供，后续功能或增值服务可能需要付费使用。具体收费标准、计费方式以平台页面公示为准。

5.1 English: Some functions of the Platform are provided on a short-term free trial basis, and subsequent functions or value-added services may require payment. Specific charging standards and billing methods shall be subject to those published on the Platform pages.

5.2 中文： 您通过本平台支持的支付方式进行充值或购买服务时，即视为同意按照公示的收费标准支付相应费用。

5.2 English: When you recharge or purchase services through payment methods supported by the Platform, you are deemed to agree to pay the corresponding fees in accordance with the published charging standards.

5.3 中文： 除法律法规另有规定或平台特别说明外，已消费的充值金额及购买的套餐服务不予退款。

5.3 English: Except as otherwise provided by laws and regulations or specifically stated by the Platform, consumed recharge amounts and purchased package services are non-refundable.

六、免责声明与责任限制 / VI. Disclaimer and Limitation of Liability

6.1 中文： 您理解并同意，本平台服务按“现状”和“可得到”的基础提供，我们不对服务的及时性、准确性、可靠性、完整性做任何明示或默示的保证。

6.1 English: You understand and agree that the Platform's services are provided on an "as is" and "as available" basis, and we make no express or implied warranties regarding the timeliness, accuracy, reliability, or completeness of the services.

6.2 中文： 因不可抗力（包括但不限于自然灾害、战争、政策变化、网络攻击、电力中断、第三方服务故障等）导致服务中断或数据丢失的，本平台不承担责任，但我们将尽合理努力减少对您的影响。
